Update: MCSO investigates death of two people

CLIFTON, Colo- The Mesa County Coroner’s Office has completed its examination regarding the deaths of two people at a residence on the 400 block of Lois Street in Clifton Monday morning.

The County Coroner’s Office has identified them as Richard Garcia Jr., a 30-year-old male resident of Grand Junction, Colorado and Stephen Summers, a 47-year-old male resident of Clifton, Colorado. Stephen Summers is the step-father to Richard Garcia Jr. 

The County Coroner’s Office has determined cause of death for Richard Garcia Jr. is multiple shotgun wounds of the head and torso and the manner of death is homicide. The cause of death for Steven Summers is shotgun wound of the head and the manner of death is suicide. Toxicology for both are pending at this time.

There are no outstanding suspects and no one is in custody. This is believed to be an isolated incident.

This case is still under investigation by the Mesa County Sheriff's Office.

MESA COUNTY, Colo. — Today the Mesa County Board of Commissioners officially dedicated this week to Correctional Officers of Mesa County.

Sheriff Matt Lewis and Detention Deputy Michael Hand joined the Mesa County Board of Commissioners in recognizing the professionalism and dedication of our detention deputies and staff during National Correctional Officers Week, May 5-11th.

In 1984, President Ronald Reagan created National Correctional Officers Week to honor the work of correctional officers and correctional personnel nationwide. In Mesa County, this group of professionals are known as detention deputies.

Local jails, like the Mesa County Detention Facility, are complex organizations. On a basic level, a jail must provide its inmate population a number of services, including three meals a day, medical and mental health care, clothing and linens, visitation, recreation, religious programs, as well as access to courts and attorneys. Complicating this task is the diversity of needs within the increasing inmate population while maintaining the safety and security of the 24-hour facility. In 2018, the Mesa County Detention Facility processed 6,653 people and provided more than 630,000 meals. On July 23, 2018, the Mesa County Detention Facility housed a record high of 629 inmates.

“The dedicated men and women who work inside our detention facility, 24/7, 365 days a year, play a vitally important role in keeping our Community safe. Their job is difficult and not one many people want to do,” said Capt. Art Smith. “Today, this week, we need to say Thank You to these professionals for their service to our Community.”

Being a detention officer can be a dangerous job. The names of 713 correctional officers are engraved on the National Law Enforcement Officers Memorial. One of those names is Deputy Edward Innes, who was killed by an inmate escaping the jail in 1906. A wreath first displayed in the Mesa County Sheriff's Office lobby, will be placed on Innes' grave this week to honor and remember his sacrifice.  Learn more about Deputy Edward Innes here

MESA COUNTY, Colo - This Correctional Officer’s Week the Mesa County Sheriff’s Office honors and remembers the sacrifice made by Edward Innes, the first law enforcement officer to lay down his life in the line of duty in Mesa County.

On September 26, 1906, Deputy Edward Innes was struck from behind with a piece of wood and became the first Mesa County law enforcement officer to die in the line of duty. Inmate George McGarvey, jailed since April 1, 1906 on charges of attempting to criminally assault a nine–year-old girl, used the attack on Innes to escape the Mesa County Jail. 28-year-old Innes passed away the following day.

McGarvey was captured by DeBeque rancher William McDowell on September 30 and then tried on October 3. He was convicted on October 4 and sentenced to death by hanging on October 5, 1906. A swift justice for what was described as one of the foulest deeds enacted in Grand Junction.

Edward Innes, a resident of Grand Junction since the age of four, was the only child of William and Lucy Innes. Edward’s father was the first elected Sheriff of the newly formed Mesa County from 1885 to 1886. Edward was Chief of the Grand Junction Fire Department for several years prior to his employment in the Mesa County Jail. When William Innes passed away November 28, 1926, it was noted that Edward was “named to the responsible position of Undersheriff.” No other mention of this title has been found.

Although Edward never married and had no children, descendants of the Innes clan can be found throughout the country, including Harold Daniels of Grand Junction whose mother Josie was Edward’s cousin. Harold and his wife Claudelle attended Edward Innes’ induction into the Colorado Law Enforcement Officers’ Memorial on May 5, 2000 at the Colorado State Patrol Academy.

Several years later, the request was made to add Edward Innes to the National Law Enforcement Officers’ Memorial. The request was granted on February 13, 2007. The name of Edward Innes was unveiled on May 13, 2007 at the 19th annual candlelight vigil as part of the National Police Week celebration in Washington, D.C.

As referred to by family and friends of Edward in a Daily Sentinel article dating September 28, 1906 – His character was above reproach, his disposition was such that drew to him readily warm friends that never wavered in their regard for him. True hearted, high and noble in his impulses and faithful to his friends there is little wonder that he was popular and there is little wonder the entire city should be stirred with indignation and anger over his tragic death at the hands of the vilest of criminals that was ever confined in a Mesa County prison.

In December of 2017, Innes was awarded the Medal of Honor posthumously. Family members still living in Colorado accepted the award on his behalf.

Following Correctional Officers Week tradition, a wreath first displayed in the Mesa County Sheriff's Office lobby, will be placed on Edward Innes' grave to honor and remember his sacrifice.

Grand Junction man arrested on sex crimes charges

MESA COUNTY, Colo – Mesa County Sheriff’s Deputies arrested a Grand Junction man Thursday for sex assault charges after a warrant for his arrest was obtained. 

Mark Koury, 59, of Grand Junction is facing the following charges:
  • 2 Counts of Sexual Assault (Class 4 Felony)
  • 2 Counts of Invasion of Privacy for Sexual Gratification (Class 1 Misdemeanor)
  • Sexual Exploitation of a Child (Class 5 Felony)
  • 2 Counts of Patronizing a prostitute (Class 1 Misdemeanor)
  • Unlawful Sexual Contact (Class 1 Misdemeanor)
These charges stem from alleged incidents that occurred between December 2017 and May 2018 involving three adult victims and possession of child pornography.

This is still an on-going investigation.

Two injured in morning assault

MESA COUNTY, Colo – Tuesday, at approximately 7:15 in the morning Mesa County Sheriff’s deputies responded to a report of an assault on the 3600 block of E ¼ Road. The Palisade Police department, De Beque Marshal’s Office, and East Orchard Mesa Fire Department also responded.

Two adult males, ages 28 and 33, were transported to St. Mary’s hospital with serious but not believed to be life-threatening injuries.

One person was detained at the scene. There are no outstanding suspects. This is believed to be an isolated incident.

Investigators are currently interviewing witnesses as well as collecting evidence and processing the scene.

This remains an ongoing and active investigation.

The Mesa County Sheriff’s Office is the investigating agency for this incident.

Update: Arrest made in Tuesday stabbing

MESA COUNTY, Colo - Mesa County Sheriff's Investigators have made an arrest in connection with Tuesday morning's stabbing that occurred at a residence on the 3600 block of E ¼ Road.

Santiago Gabriel Martinez, age 40, has been arrested for the following charges:
  • 2 counts of Assault in the First Degree (Class 3 Felony)
  • 3 counts of Menacing (Class 5 Felony)

The two adult male victims, ages 28 and 33, remain hospitalized.

Clifton man arrested on multiple counts of sex crimes on a child

MESA COUNTY, Colo – Mesa County Sheriff’s deputies took Roman Cruz Lopez, 29, of Clifton into custody Tuesday after a warrant was obtained for his arrest.

Lopez faces the following charges:
  • 2 Counts of Sexual Assault on a Child as part of a Pattern of Abuse (Class 3 Felony)
  • 9 Counts of Sexual Assault on a Child by one in a Position of Trust, Pattern of Abuse (Class 3 Felony)
The charges stem from alleged incidents that occurred between April 2018 and May 2019 involving a juvenile victim.

Mesa County man arrested on multiple counts of sex crimes on a child

MESA COUNTY, Colo – Mesa County Sheriff’s deputies took Travis Polutnik, 27, of Clifton into custody Thursday after a warrant was obtained for his arrest.

Polutnik faces the following charges:
  • 3 counts of Sexual Assault on a child by one in a position of trust (Class 3 Felony)
  • 3 counts of Sexual Assault on a child by one in a position of trust and pattern of abuse (Class 3 Felony)
  • 1 count of Sexual Assault on a child- with force, (Class 3 Felony)
  • 3 counts of Sexual Assault on a child in a pattern of abuse, (Class 3 Felony)
  • 3 counts of Aggravated Incest (Class 3 Felony)
  • Jessica's Law, a sentence enhancer
  • Crime of violence, a sentence enhancer
The charges stem from alleged incidents that occurred between January 2014 and May 2019 involving a juvenile victim.

This is still an on-going investigation.

CIRT activated to investigate officer-involved shooting

At approximately 1:00 a.m. on Friday, June 14, 2019, officers with the Grand Junction Police Department responded to a report of a suicidal male with a gun outside a residence in the 2400 block of Jack Creek Road.

When officers arrived, the 29-year-old male was found walking eastbound on Jack Creek Road with a handgun. A confrontation occurred between the male and officers on scene and an officer-involved shooting occurred.

The male was transported to St. Mary’s hospital via ambulance and is currently being treated for his injuries. No officers were injured.

As with all officer involved shootings in Mesa County, the 21st Judicial District Critical Incident Response Team, comprised of representatives of the Grand Junction Police Department, Mesa County Sheriff’s Office, Fruita Police Department, Palisade Police Department, Colorado State Patrol, 21st Judicial District Attorney’s Office, Colorado State Parole, and Colorado Bureau of Investigation, is responsible for the investigation of this incident.

Law enforcement continues to process the scene of this incident for additional evidence. Residents in the area may see an increased presence of law enforcement personnel over the next several hours.

Members of the Critical Incident Response Team will conduct interviews of all witnesses and involved persons in this case over the coming days. Additional details will be released as appropriate, with sensitivity to the ongoing investigation.

The Grand Junction Police Department will be responsible for releasing the names of the involved officers. As per their agency’s policy, the officers will be placed on administrative leave.

Rudy Gillean, 49, of Grand Junction was arrested at the campground for Domestic Violence, Harassment Strikes Shoves Kicks (Class 3 Misdemeanor). 
Jason Apodaca, 39 of Albuquerque, NM was arrested at the campgrounds for Possession of a Schedule I/II Substance (Cocaine) (Class 4 Drug Felony).
Drew McKinzie, 24 of Grand Junction was arrested for Violation of a Protection Order (Alcohol) (Class 1 Misdemeanor).
Lower Valley Fire Protection District treated 31 patients on site with 4 transports to the hospital. The breakdown for treatment is as follows: 10 allergic reactions, 6 alcohol intoxication, 1 cardiac, 5 dehydration and 9 traumas.

Mark Barniville, 39, of Grand Junction was arrested in the festival area for Second Degree Assault on a Peace Officer (Class 4 Felony).

Lower Valley Fire Protection District treated 66 total patients on site with 1 person transported to the hospital. The breakdown for treatment is as follows: 9 allergic reactions, 13 alcohol intoxication, 1 cardiac, 14 dehydration, and 28 traumas.  Lower Valley also responded to 2 small grass fires on site.

Delta teen arrested on multiple charges after chase

MESA COUNTY, Colo –  On Friday, June 14, 2019 at approximately 9:45pm Mesa County Sheriff’s deputies responded to a report of a grey Chevy pickup driving at high speeds on the wrong side of Highway 50 around mm 61 headed towards Grand Junction. 

Deputies caught up with the pickup truck as it was driving directly between both lanes of westbound travel.  It did not stop as deputies tried to pull the truck over. The driver continued to drive erratically at times attempting to hit patrol vehicles. 

The truck continued to drive at speeds reaching 90 mph and erratically weaving in and out of traffic lanes into oncoming traffic as well as at times throwing trash out of the window onto the highway. 

Colorado State Patrol troopers shut down traffic at Highway 50 and 28 ½ Road.  Deputies were able to perform a Tactical Vehicle Intervention maneuver to stop the pickup just west of 28 ½ Road. The driver, identified as 19-year-old Sabastian Soto of Delta, got out of the truck and ran from law enforcement. He was found in a backyard at a residence on the 100 block of Glory View Drive. 

Soto is facing the following charges:
  • 14 counts of Failed to Drive in a Single Lane (Weaving) 
  • 14 counts of Failed to Use Turn Signals
  • 3 Counts of Second Degree Assault on a Police Officer (Class 4 Felony) 
  • 3 Counts Reckless Driving
  • 3 Counts Reckless Endangerment (Class 3 Misdemeanor)
  • 3 Counts Vehicular Assault while Under the Influence of Alcohol or Drugs (Class 4 Felony)
  • 2 Counts of Second Degree Criminal Trespass
  • DUI – Drove Vehicle while under the Influence 
  • Vehicular Eluding (Class 6 Felony) 
  • Unlawfully Carrying a Concealed Weapon-Unlawful Possession of Weapons (Class 2 Misdemeanor)
  • Speeding 25-39 MPH Over Limit
  • Aggravated Driving with Revoked License Habitual Offender Commits DUI (Class 6 Felony) 
  • Drove Vehicle when License under Restraint
  • Resisting Arrest (Class 2 Misdemeanor) 
  • Obstructing Peace Officer (Class 2 Misdemeanor)
  • Violation of a Protection Order (Class 2 Misdemeanor)

Mesa County Sheriff's deputies also responded to several calls including intoxicated subjects, fights, and a report of selling counterfeiting merchandise resulting in several people being removed from Country Jam grounds.  
Holden Kleager, 19, of Glenwood Springs, was arrested for Criminal Impersonation (Class 6 Felony), Resisting Arrest (Class 2 Misdemeanor), Obstructing Peace Officer (Class 2 Misdemeanor), Minor in Possession of Alcohol, and Possessed Fictitious Driver’s License.

Lower Valley Fire Protection District treated 84 total patients on site. The breakdown for treatment is as follows: 10 allergic reactions, 6 alcohol intoxications, 20 dehydrations, 4 respiratory, 44 trauma. Traumas include care for injuries, burns, lacerations, wound care, and orthopedic injuries.

Colorado State Patrol made two DUI arrests and issued 6 tickets for failure to yield to emergency vehicles. Remember, MOVE OVER into the left lane and SLOW DOWN for emergency vehicles stopped on the roadside, it’s the law.

We encourage festival goers to have a good time, but be safe and follow the law. Please DON'T DRINK and DRIVE.

William Sexton, 31, and Janel Sexton, 20, of Broomfield were issued a summons for Child Abuse (Class 2 Misdemeanor) and removed from the grounds after an infant in their care was found suffering from heat stroke and sun exposure. The child was transported to the hospital via ambulance.

Lower Valley Fire Protection District treated 32 total patients on site with 4 transports to the hospital. The breakdown for treatment is as follows: 3 allergic reactions, 3 alcohol intoxications, 1 cardiac, 3 dehydrations, 4 respiratory, 13 trauma. Traumas include care for injuries, burns, lacerations, wound care, and orthopedic injuries.

Mesa County Sheriff's Deputies also made seven arrests during the four-day festival. Charges included Domestic Violence, Harassment Strikes Shoves Kicks (Class 3 Misdemeanor), Restraining Order Violation, Possession of a Schedule I/II Substance (Cocaine) (Class 4 Drug Felony, Second Degree Assault on a Peace Officer (Class 4 Felony), Criminal Impersonation (Class 6 Felony), Resisting Arrest (Class 2 Misdemeanor), Obstructing Peace Officer (Class 2 Misdemeanor), Minor in Possession of Alcohol, and Possessed Fictitious Driver’s License as well as Child Abuse (Class 2 Misdemeanor).

Deputies also responded to several calls of intoxicated subjects, fights, and a reports of people selling counterfeiting merchandise resulting in several people being removed from Country Jam grounds. 
During the 4-day festival Lower Valley Fire Protection District treated 213 total patients on site with 9 transports to the hospital. Treatments included allergic reactions, alcohol intoxications, cardiac, dehydration, respiratory, and trauma. Traumas include care for injuries, burns, lacerations, wound care, and orthopedic injuries.

Colorado State Patrol made two DUI arrests and issued 6 tickets for failure to yield to emergency vehicles.  During the 4-day festival there were zero DUI related crashes, a first in recent memory!

Remember, MOVE OVER into the left lane and slow down for emergency vehicles stopped on the roadside, it’s the law.

MESA COUNTY, Colo – An inmate is facing new charges today stemming from an incident that occurred in the Mesa County Detention Facility.

David Castro, 32, of Clifton is accused of stabbing another inmate with an improvised weapon on June 13, 2019 at approximately 4:00 in the afternoon.

The victim was transported to the hospital and treated for his injuries. He has since been released and is back in the Mesa County Detention Facility.

Castro is facing the following charges:
  • Criminal Attempt of 1st Degree Murder (Class 2 Felony)
  • 1st Degree Assault (Class 3 Felony)
  • Felony Menacing (Class 5 Felony)
The case is still under investigation.

No fire restrictions for July 4th, fire danger still a concern

MESA COUNTY, Colo – The Mesa County Sheriff’s Office and the Upper Colorado River Interagency Fire Management Unit have determined current conditions do not warrant implementing fire restrictions, but advise people to celebrate the Fourth of July responsibly. 

Spring rains created an abundance of rarely seen green around the valley, but that lush growth is now dormant, dried and ready to burn. Right now in Mesa County fine fuels, such as grass, have already dried and cured for the season and could easily catch and spread wildfire quickly.

“We wish everyone a safe Independence Day. Please be responsible and respectful if you choose to use legal fireworks. There is a concern for human caused fires during the holiday weekend, especially in lower elevations,” said Mesa County Sheriff Matt Lewis. “Be mindful of your surroundings and respectful of others as you enjoy this holiday weekend.”

On July 4th more fires are reported than any other day of the year and fireworks are the cause for more than half of them, according to the National Fire Protection Association.

“As we head into the busy holiday weekend remember to exercise caution and common sense when setting off LEGAL fireworks,” said Grand Junction Fire Chief Ken Watkins.

When using fireworks it is extremely important to stay away from dry grass and wooded areas. It just takes one spark to start a wildfire that can put lives and property at risk.

"Recreational users on public lands should keep a few things in mind that can help prevent an unintentional wildfire,” said Bureau of Land Management Acting Field Manager Wayne Werkmeister. “Practicing proper vehicle maintenance; ensuring that tow chains are secured and a vehicle has no dragging parts, and properly maintaining your breaks. Park your vehicles/trailers and off-highway vehicles away from dry grass or brush. When target shooting taking a few simple precautions can prevent devastating results: place your target on dirt or gravel, switch to paper targets, bring a shovel and fire extinguisher, and report any fires by calling 911."

The use of fireworks, flares, or other incendiary devices, including exploding targets, are always prohibited on federal lands.

FIREWORKS FACT
  • The use of fireworks on federal land is always ILLEGAL. 
  • It is ILLEGAL to knowingly sell or provide fireworks to anyone under 16 years of ages. No one under the age of 16 can purchase fireworks. Colorado law requires adult supervision for persons under 16 years of age to possess or discharge fireworks. 
  • Permissible LEGAL fireworks include: Cylindrical or cone fountains, wheels and ground spinners, illuminating torches and colored fire, dipped sticks and sparklers, toy propellant or toy smoke devices, trick noise makers and snake or glow worms are all permissible. 
  • ILLEGAL Fireworks: Fireworks not meeting the definition of permissible fireworks including but not limited to cherry bombs, roman candles, firecrackers, bottle rockets, shells and rockets, M-80s and M-100s, and helicopters are all examples of illegal fireworks. 
  • A good rule of thumb: anything that explodes or leaves the ground is most likely ILLEGAL in Colorado.

  • 9:30pm at Snooks Bottom in Fruita: The Fruita Parks and Recreation department will be hosting a fireworks display at dusk. The fireworks will be launched from Snooks Bottom. There is no designated viewing area.
Thursday, July 4th
  • 10:30-11:00am Independence Monument: Mesa County Search and Rescue Technical Team will climb Independence Monument and raise the American Flag. Viewing locations at several view points on the Colorado Monument.
  • Fireworks after the GJ Rockies Game at Lincoln Park: Game attendees are invited to stay in the stadium to enjoy the fireworks show, and community members are invited to bring their families and watch the display from Lincoln Park.

29th Annual Independence Monument Climb on 4th of July

MESA COUNTY, Colo – Mesa County Search and Rescue Technical Rescue Team is gearing up for their 29th annual climb up Independence Monument to raise the American Flag. There are a total of 15 climbers at this year’s event. Nine Search and Rescue members will be accompanied by six guest climbers. Four of the guest climbers this year are military veterans, two Army and two Marines.

Along with the celebration of our nation’s freedom, all proceeds from this event will go towards the purchasing of equipment and training for Mesa County Search and Rescue Team.

How to watch

Independence Monument
This year’s flag-raising ceremony will take place on top of Independence Monument around 10:30 AM – 11:00 AM on July 4th. Plan on being in place around 10:00 AM. They are very experienced climbers and climb fast!

The viewing opportunities to see this event will be Independence Monument View and at the end of Otto’s Trail. If both of these parking areas are full, you will also have a view of Independence Monument from Book Cliff Shelter and Grand View.

Please keep in mind the entry fee for the Colorado National Monument is $20 per vehicle. Colorado National Monument annual passes and America the Beautiful Passes are also honored.

Man rescued from fall at Potholes

MESA COUNTY, Colo - A 36-year-old male was rescued from Potholes near Glade Park yesterday. At approximately 5:30 pm Friday, July 5th, we received reports of a male had fallen 25-30 feet into a rock crevice.

Glade Park Fire Department, Grand Junction Fire Department, Mesa County Sheriff’s Office, Mesa County Search and Rescue, Technical Rescue Team, and CareFlight responded to the remote area.

The Mesa County Technical Rescue Team and Grand Junction Fire Department Rescue Team used ropes to reach the injured man, then hoisted him back up the cliffside. It took several hours to complete the very technical rescue.

The man was transported to the hospital via CareFlight with major injuries, but was conscious and breathing.

Alcohol is believed to be a contributing factor to the accident. We want to remind everyone choosing to recreate outdoors to do so sober.

The children are believed to be traveling with their mother, Shiann Moore, of Clifton in a 2001 silver Pontiac Grand Prix with a Colorado license plate GOA169.  They were last seen Saturday evening at a residence on E. Carolina Ave, in Fruita. Investigators with the Mesa County Sheriff’s Office would like to make sure they are safe. If seen, please call (970) 242-6707 or call 911.

MESA COUNTY, Colo – Mesa County Sheriff’s deputies are trying to determine the whereabouts of a Clifton woman and her three children to determine their well-being.

Shiann Moore, 27, of Clifton is believed to be with her three children, Lillie Faries,10, Timothy Pearce, 7, and Sabrina Pearce 10 months.

They were reported missing last night by family who have not heard from them in several days. They were last seen Saturday evening at a residence on E. Carolina Ave, in Fruita. They are believed to be traveling in a 2001 silver Pontiac Grand Prix with a Colorado license plate GOA169.

Investigators do not have anything to indicate the family is in immediate danger, but would like to verify Moore and her children are safe.

Shiann Moore is described as a white female, 27 years old, 4’11, 125 pounds, with blonde hair and brown eyes. It is possible she could have a different hair color.

Lillie Faries, 10, is described as a white female, 4’0, 60 pounds, with blonde hair and blue eyes.

Timothy Pearce is a 7-year-old boy, Sabrina Pearce is a 10-month-old girl.
